After helping broker the Black Sea Grain Initiative in the wake of Russia\u2019s invasion of Ukraine\u202fin 2022, the ICC,\u202fwhich\u202frepresents\u202fmore than 170 countries,\u202fhas helped develop a similar\u00a0neutral\u00a0framework for the Gulf.\u00a0<\/p>\n<p>Read more <a href=\"https:\/\/crosscountrymovingteams.com\/?p=4881\">How Zohran Mamdani\u2019s pied-\u00e0-terre tax exposed an epidemic of \u2018ghost cars\u2019 instead<\/a><\/p>\n<p>The proposed mechanism\u202festablishes\u202fa practical framework for the registration, monitoring, verification and reporting of vessel movements through the Strait, with\u202fan initial\u202ffocus on fertilisers and related raw materials.\u00a0<\/p>\n<div>\n<div>\n<div><\/div>\n<\/div>\n<\/div>\n<p>\u201cThis is not the first time we\u2019ve been involved in coming up with a mechanism which can reopen a trade route in the midst of conflict,\u201d Denton told\u00a0<em>Fortune<\/em>.\u00a0<\/p>\n<p>\u201cThe logic behind that deal was an exchange of incentives;\u00a0Ukraine gained the ability to move wheat and sunflower products, while Russia gained the ability to move fertiliser. Whereas,\u202fat the moment, what\u202fwe\u2019re\u202fseeing with the Iran conflict is that the only way of\u202fexchanging incentives is escalation, which is not going to get us to a peaceful reopening of Hormuz. And\u202fthat\u2019s\u202fwhere we think our neutral governance mechanism could prove decisive.\u201d\u00a0<\/p>\n<p>The mechanism,\u202fas currently proposed,\u202fwould have a dedicated task force led by the Executive Director of the United Nations Office for Project Services (UNOPS), Jorge Moreira da Silva. It would\u00a0include\u00a0representatives from the UN Conference on Trade and Development (UNCTAD)\u00a0and the\u00a0International\u202fMaritime Organization (IMO).\u00a0\u00a0<\/p>\n<p>Once in place, a Joint Co-ordination\u00a0Center\u00a0(JCC)\u00a0would\u00a0facilitate\u00a0secure\u00a0shipping corridors,\u00a0oversee the loading of fertilizer and related raw materials, verify and\u202fmonitor\u202fparticipating vessels, and publish weekly reports detailing its activities.\u00a0<\/p>\n<div>\n<div><\/div>\n<\/div>\n<p>The\u202fJCC\u202fwould\u202fbe\u202flocated\u00a0in\u202fSalalah on the coast of the Arabian Sea in southern Oman\u202fand its members would meet daily to review incoming, verified requests from vessels and provide deconflicted\u00a0routes through the Strait for inbound and outbound vessels.\u202f\u00a0<\/p>\n<p>\u201cPeople have\u202fhad a habit during this horrible dispute of announcing the strait is open,\u202fthe\u202fstrait is closed, or\u202fthat there\u2019s a\u202fpartial opening,\u201d said Denton.\u00a0\u00a0<\/p>\n<div>\n<div>\n<div><\/div>\n<\/div>\n<\/div>\n<p>\u201cBut,\u202fultimately,\u202fwe actually have to ensure that the trade route functions.\u202fThat means engaging the full economic ecosystem\u2014shipowners, seafarers, insurers, port handlers, commodity traders, and financiers\u2014all of whom need certainty before\u202fthey\u2019ll\u202fmove goods again.\u202f\u00a0<\/p>\n<div>\n<div><\/div>\n<\/div>\n<p>\u201cWhat\u202fwe\u2019ve\u202fstrived\u202fto do in building this mechanism\u202fis\u202fto\u202fensure that it will be acceptable and usable by that economic ecosystem.\u202fAnd that requires obviously deconfliction of the area. It requires then a commitment to the neutral governance of the area in terms of the ability to inspect, etc., but at scale and\u202ffrequently, not once every\u202ftwo\u202fweeks.\u201d\u00a0<\/p>\n<div>\n<div><\/div>\n<\/div>\n<div>\n<div><\/div>\n<\/div>\n<p>While vessel inspections are not compulsory, member states can request a secondary inspection of a vessel\u202fin line with specified criteria. These inspections would be conducted by Oman\u2019s Salalah Port Authority,\u202fobserved\u202fby UN monitors, with the results shared\u00a0amongst\u00a0Joint Coordination\u202fCenter\u202fmembers before the vessel\u202fproceeds.\u00a0<\/p>\n<p>The proposed mechanism, like its Black Sea predecessor, would be time-bound and explicitly would not \u201cderogate from any freedom of navigation rights \u2026 under customary or conventional international law,\u201d explained Denton, who previously served as\u202fhead\u00a0of the\u00a0Australian legal giant Corrs Chambers Westgarth.\u00a0<\/p>\n<p>Read more <a href=\"https:\/\/crosscountrymovingteams.com\/?p=4879\">An 130-year-old theory from an obscure Swedish economist explains why investors will keep funding America\u2019s near-$40 trillion pile of debt<\/a><\/p>\n<p>The mechanism does not\u202findicate\u202fa\u202ftimeframe,\u202fbut the idea is that it would\u202foffer up a neutrally administered bridging solution\u202funtil a more permanent\u00a0plan\u202fis\u202fagreed.\u202f\u00a0<\/p>\n<p>Denton said the mechanism is ready to be deployed in a matter of weeks, if not sooner, but\u202facknowledged that a workable trade corridor\u202fcan\u2019t\u202fsimply be declared\u202finto existence. He added that he\u202fdidn\u2019t\u202fknow whether Iran would agree to the mechanism, but that\u202fthey\u2019re\u202faware of it.\u00a0<\/p>\n<div>\n<div>\n<div><\/div>\n<\/div>\n<\/div>\n<div>\n<div><\/div>\n<\/div>\n<p>It took three years to negotiate the Malacca mechanism covering the straits in East Asia that is often cited as a reference point for Hormuz.\u00a0<\/p>\n<p>\u201cThis\u202fisn\u2019t\u202fsomething we can impose. Its implementation depends on the parties to the conflict reaching the view that it is a worthwhile initiative and agreeing to move ahead,\u201d he said.\u202f\u00a0<\/p>\n<p>While\u202fthe Black Sea Grain Initiative involved resolving a dispute between two parties\u2014Ukraine and Russia\u2014the Strait of Hormuz involves a web of states with competing territorial claims and significant international legal issues.\u00a0<\/p>\n<\/p>\n<div>\n<div><\/div>\n<\/div>\n<p>Article 5 of\u202fthe U.S.-Iran\u00a0Memorandum of Understanding\u00a0was intended as a confidence-building measure to restore commercial shipping through the Strait of Hormuz but has\u202finstead\u202femerged\u202fas the primary sticking point. Its vague\u00a0wording has led to\u202fconflicting interpretations of control, competing shipping routes,and confusion overthe 60-day fee waiver limit\u00a0<\/p>\n<p>Iranian President Masoud Pezeshkian said on Sunday that the\u00a0MoU\u00a0that Iran signed in June with the U.S. would become the \u201ccornerstone\u201d of Tehran\u2019s future foreign relations.\u00a0<\/p>\n<div>\n<div>\n<div><\/div>\n<\/div>\n<\/div>\n<p>Denton pointed to the MoU\u2019s legal ambiguity as a genuine weak point: \u201cArticle 5 is a challenge because the Iranians have clearly taken from Article 5 that they\u2019ve been given the right to develop an administrative mechanism for the conduct of shipping through the Strait of Hormuz, a reading that the U.S.\u00a0disputes.\u201d\u00a0<\/p>\n<p>Denton also expressed concern over the ongoing talks taking place in the region.\u202f\u00a0<\/p>\n<div>\n<div><\/div>\n<\/div>\n<p>\u201cIf an agreement were\u202fto be signed between Iran and Oman, can it actually hold?\u201d he said.\u202f\u00a0<\/p>\n<p>\u201cAren\u2019t you going to need to have the U.S.\u202finvolved with that as well?\u202fAnd then,\u202fif the U.S.\u202fis to be involved, then how do the parties have confidence\u202fbecause no one\u202fcurrently\u202ftrusts anyone.
